These Terms govern your use of aircaretodayhvac.com (the "Site"), operated by Toler Air Care Today LLC, doing business as Air Care Today ("Air Care Today," "we," "us"), and our text messaging program. By using the Site or opting in to text messages, you agree to these Terms.

1. Website use

• The Site gives general information about our heating, air conditioning and refrigeration services. It is not a substitute for an on-site inspection by a qualified technician.
• Information on the Site may change without notice. Any quote, scope of work, pricing or warranty applies only when we provide it to you directly, for your specific job.
• Submitting a form or booking request does not guarantee an appointment until we confirm it.
• You agree not to misuse the Site, including by submitting false information, spam or malicious code.

2. Safety

If you smell gas or a carbon monoxide alarm sounds, leave the building and call your gas utility or 911. Do not rely on the Site or a text message in an emergency.

3. Intellectual property

The Site's content, including text, design and logos, belongs to Air Care Today or its licensors and may not be copied for commercial use without permission.

4. Third-party links

The Site links to third-party sites (such as Google Calendar for booking). We are not responsible for their content or practices.

5. Our old domain

aircaretoday.com is not owned or operated by Air Care Today. We are not responsible for any content, phone numbers, services or transactions connected with it. See our notice.

6. SMS Program Terms

• Program name: Air Care Today Service Messages
• Description: Air Care Today sends text messages about your service requests, including appointment confirmations, appointment reminders, service updates, and replies to your inquiries. We do not send marketing messages through this program.
• How you opt in: by checking the optional text-message consent box on our contact form, or by asking us to text you. Consent is not a condition of purchase.
• Message frequency varies based on your service requests and appointments.
• Msg & data rates may apply. Check your mobile plan for details.
• Opt out: reply STOP to any message to cancel. We'll send one confirmation message, and then no more messages unless you opt in again.
• Help: reply HELP to any message, or contact us at (512) 333-1135 or [email protected].
• Carriers are not liable for delayed or undelivered messages.
• Age: you must be at least 18 years old, or have the permission of a parent or guardian, to opt in. You must be the account holder or an authorized user of the mobile number you provide.
• If you change or give up your mobile number, please reply STOP from that number or let us know so we can update our records.

7. Disclaimers

The Site is provided "as is." To the fullest extent allowed by law, we disclaim all warranties about the Site, express or implied. This does not affect any written warranty we give you for a specific job or any rights you have under Texas law that can't be waived.

To the fullest extent allowed by law, Air Care Today is not liable for indirect, incidental or consequential damages arising from your use of the Site or the text messaging program.

9. Governing law

These Terms are governed by the laws of the State of Texas.
